I am voluntarily choosing to use the facilities and/or participate in fitness classes or personal training sessions provided by Evolve Personal Performance. I understand that these services may include unsupervised Open Gym access and/or participation in sessions led by a certified personal trainer contracted through Evolve Personal Performance.
I understand that all physical activity, whether supervised or unsupervised, involves inherent risks of injury, including but not limited to muscle strains, sprains, falls, equipment-related injuries, and in rare cases, more serious health events. I acknowledge that I am responsible for monitoring my own condition at all times and will inform the trainer (when present) of any discomfort, pain, or medical concerns that may arise.
For Open Gym Use:
I understand that during Open Gym sessions, no trainer or staff member will be present, and I am solely responsible for my safety, actions, and decisions while using the facility and equipment.
I agree to:
Only use the facility within the scope of my current fitness level and medical condition;
Refrain from using equipment or performing movements I do not understand or that may place me at risk;
Not allow anyone under the age of 18 to be present or participate unless directly supervised by a parent or guardian;
Only bring individuals with me who are current members or clients who have completed their own waiver;
Not hold Evolve Personal Performance liable for any injury, illness, or incident that may occur while using the gym during unsupervised hours.
For Fitness Classes and Personal Training Sessions:
I understand that these training sessions may include, but are not limited to, strength training, cardiovascular exercise, flexibility training, mobility work, and other physical fitness activities. I am aware that even under the guidance of a certified personal trainer, risks are still present.
I acknowledge that it is my responsibility to inform the trainer of any medical conditions, injuries, limitations, or concerns prior to or during participation. I certify that I am in good health and physically capable of participating, and that I have either received medical clearance or have chosen to participate at my own risk.
Cancellation & Billing Policy
Open Gym Memberships
Open Gym operates on a monthly subscription basis.
It is the client’s responsibility to cancel their subscription prior to the renewal date.
Refunds will not be issued once the monthly subscription renews.
Clients will retain access through the end of their paid billing cycle unless access is revoked for policy violations or safety concerns.
Certain exceptions may apply at the discretion of Evolve Personal Performance.
Fitness Class Memberships
Monthly class memberships also auto-renew and are the responsibility of the client to cancel prior to renewal.
It is the client’s responsibility to book their classes.
If no one is booked at least 1 hour prior to the class start time, the class may be canceled.
Class cancellations must be made at least 24 hours in advance.
Personal Training Sessions
Personal training sessions must be canceled more than 24 hours in advance.
Late cancellations or no-shows may result in being charged the full session fee.
If the session fee has not yet been collected, an invoice may be issued.
Additional scheduling may be restricted until the outstanding balance is paid.
Liability Release:
In consideration of being granted access to Evolve Personal Performance and its programs, I hereby release, waive, discharge, and hold harmless Evolve Personal Performance, its owners, trainers, contractors, employees, and affiliates from any and all claims, liabilities, damages, losses, or expenses that may arise from my participation or use of the facility—whether due to negligence or otherwise.
